Legal drafting is one of the most important elements of legal practice. Legal drafting is a combination of two words, “legal” and “drafting”. Literally, the word “legal” means something that suits the law, whereas “drafting” means planning or constructing.
Vice Spokesperson of Provincial House of Representative, Special Region of Yogyakarta (DPRD DIY), Arief Noor Hartanto started his Lecture by explaining the definition of Legislative Drafting, in front of students of Faculty of Law, Universitas Muhammadiyah Yogyakarta who taking the Course “Legislative Drafting”, Thursday, November 29th, 2018 at Kasman Singodimedjo Seminar Room, Universitas Muhammadiyah Yogyakarta.
Arief explained that the definition and scope of legal drafting is different from legislative drafting. Legislative drafting relates to the design of laws and regulations made by authorized authorities, in the form of laws, government regulations, presidential regulations, regional regulations, and other types of legislation. While legal drafting relates to legal designs made by legal subjects both individuals and/or legal entities.
Arief also urges students to mastering the legislative drafting. “We see the qualification of our representatives in DPRD who has no sufficient ability and enough basis on the regulation-drafting, and the only can help them to improve that ability is graduate from School of Law who has that basis in law and legislative drafting“, Arief said.
Nanik Prasetyoningsih, a lecturer who handle the Course Legislative Drafting stated that a complete understanding of legal drafting is very important for legal practitioners in various fields and agencies. “The fact remains that many have yet to understand how to draft legal drafting properly and legally“, Nanik added.
